Disciplinary Case
Company A had a disciplinary concern with a member of staff who had consumed drugs in the workplace, from the organisations stores. The employees’ health had subsequently deteriorated and resulted in them requiring intensive medical treatment. The employee was in a role of responsibility and would have been required to have provided care to vulnerable patients and therefore had place patients health at risk as well as their own.
Company A utilised Markham HR to provide extensive support and advice throughout the disciplinary process including the hearing and subsequent appeals process. Additionally the details of this case were extremely complex and therefore a large degree of coaching had been required for the management team hearing this case.
Through the support provided by Markham HR it was ensured that ‘best practice’ and internal policies had been applied correctly, whilst also ensuring that the company had acted in accordance with employment legislation.
Grievance Case
Company Z had received a formal grievance from an employee following a return to work after prolonged periods of sickness absence. The grievance related to senior members of the management team and raised serious legal allegations regarding individual treatment and potentially discrimination.
The employee had subsequently resigned and raised Employment Tribunal claims of constructive dismissal and age discrimination. Markham HR conducted an impartial grievance investigation to provide further support and evidence to company Z when preparing for the eventual Tribunal.
Sickness Absence
Company B had an employee who had been long-term sick and had not been remaining in constant regular contact and had failed to provide ‘Fit Notes’ for a substantial period of time. Markham HR had been utilised to provide support in managing the employee’s sickness absence.
Markham HR guided and coached the employer through managing the employee’s sickness absence effectively. Despite regular attempts to contact the employee, which were unsuccessful, Markham HR supported Company B in stopping the employees’ wages and dismissing the employee.
Organisational Changes & Redundancy
Company X employs 8,000 plus individuals, with 86% of total revenue being spent on staffing costs, and due to the current economic climate have been forced to reduced overall costs by £50m by 2015.
Markham HR have been providing long-term support and HR project management in 5 key areas of change within Company X, which has impacted on 500 plus staff and has led to some redundancies. The area of work conducted by Company X is extremely complex with significant public demand and therefore detailed consultations were required to ensure that quality of service would not be impacted but the provision would be more affordable.
Markham HR supported both Company X and the employees through a significant period of change which resulted in both voluntary redundancies and compulsory redundancies, but with quality services that meet increasing public demand.
